How we work with you

These terms describe the agreement between you (the traveler) and Journee, the brand operated by PeruPremiumAdventure. We wrote them this way: warm voice in headers and transitions, formal language where legal precision requires it. It's worth reading them before confirming your journey.

1.Acceptance of terms

By using Journee, talking with our chatbot, or confirming a journey, you agree to these terms. If you don't agree with any clause, please don't use the service.

To contract a journey you must have legal capacity to do so (age of majority in your jurisdiction and full civil capacity).

2.What Journee is

Journee is a human-assisted real-time travel companion that helps you craft and coordinate premium journeys in Peru.

What we do:

  • Talk with you to understand the journey you want.
  • Craft a personalized sketch: curated experiences, hotels, transfers, dates.
  • Validate operational availability with local operators in Peru.
  • Coordinate throughout your trip — before, during, and after.

What we do NOT do:

  • We don't sell standalone Machu Picchu tickets, standalone flights, or single entrance tickets.
  • We're not a quote-comparison agency. We craft full journeys, not isolated pieces.
  • We're not a hotel search engine or price aggregator.

Journee acts as the journey designer and intermediary, coordinating with accredited local operators. The physical execution in Peru is performed by those operators.

3.How a journey gets confirmed

The process, step by step:

  1. You talk with Journee and we build a journey sketch.
  2. We send you a detailed proposal with price and conditions.
  3. You confirm. You pay 30% of the total as a deposit (see section 4).
  4. Operational validation: within 12 hours of the deposit, we confirm real availability with local operators.
  5. If everything is available, the contract is finalized. We send you the final itinerary.
  6. Thirty days before the trip we charge the remaining 70%.
  7. You arrive in Peru, live your journey, and we support any adjustments.

Important: the contract is considered finalized when operational availability is confirmed, not at the moment of the 30% deposit. This protects you in "sold out" scenarios (see section 5).

4.Payments

30/70 structure:

  • 30% at journey confirmation (deposit).
  • 70% 30 days before trip start date.
  • Applies to all journeys, regardless of total amount.

Currency: USD only at this time. Other currencies (CAD, EUR, GBP) are under evaluation for future product versions.

Processing: through a regulated payment provider [final processor pending F4 closure]. Your transaction is also subject to that provider's terms.

Refunds: when applicable, processed within 5-10 business days from approval. Refund goes back to the original payment method.

Additional charges: we never charge anything outside the original proposal without your explicit written authorization.

5.Cancellation policy

If you need to cancel, refunds follow this schedule:

  • More than 60 days before the trip: 90% refund (10% retained for handling).
  • Between 30 and 60 days before: 50% refund.
  • Less than 30 days before: 0% refund.
  • Force majeure (documented illness, certified family emergency, extraordinary event): case-by-case. We work with you to reschedule at no additional cost.

Cancellation timing counts from the moment of the 30% deposit or full payment, whichever applies given the timing.

To cancel, write to us at hola@perupremiumadventure.com. The date of your email is taken as the effective cancellation date.

6.No availability for advance-booking experiences (Machu Picchu, Inca Trail, Choquequirao)

Some experiences require advance reservations (typically 3-6 months) and depend on quotas managed by Peruvian authorities. If we validate and find no availability for your dates, we offer one of three options (your choice):

  1. We propose nearby alternative dates (prioritizing what you flagged as flexible during date capture).
  2. We propose an equivalent journey without the sold-out experience (always with your explicit consent).
  3. We refund the deposit and any amount paid, in full and at no additional cost.

Operational validation happens within 12 hours of the deposit. If we don't reach confirmation in that window, we default to option 3 (full refund) unless you ask us to keep waiting.

7.Limitation of liability

Journee's role: we are journey designers and intermediaries between you and the local operators. The physical execution is performed by them.

Force majeure: we are not liable for trip disruptions caused by extreme weather, political events, strikes, governmental decisions (including Machu Picchu closures by Peru's Ministry of Culture), pandemics, or natural disasters. When applicable, we work with you to reschedule or refund per circumstances.

Government availability: Machu Picchu and other archaeological sites are administered by Peruvian state entities. Journee does not control quotas, schedules, or rules. We share what we know and update if anything changes.

Liability cap: our maximum monetary liability for any claim related to your journey is limited to the total amount actually paid by you for that specific journey.

8.Intellectual property

Your itinerary: the itinerary we craft for you is for personal use. You can share it with companions and save it, but not redistribute it commercially.

Journee brand, custom maps, illustrations, code: these are property of the Journee legal entity. Reselling, distributing, modifying, or using the service or its outputs in derivative products without written authorization is prohibited.

Your content (messages, photos shared during the journey if you choose to do so) remains yours. If you give us explicit permission to use testimonials or photos in marketing, we confirm it in writing case by case.

9.Traveler conduct

While in Peru on a Journee:

  • You comply with local laws, archaeological-site regulations, and operator rules.
  • You respect local cultures, visited communities, and the team accompanying you.
  • Some sites (Machu Picchu, Inca Trail, Choquequirao) have strict behavior rules. Compliance is the traveler's responsibility.

Behaviors such as vandalism, assault, illegal substance use, or serious breach of local rules can result in immediate cancellation of the journey without refund. In those cases costs already committed to operators are not returned.

10.Modifications to the service

We may update these terms. When we do:

  • We notify travelers with active journeys at least 30 days in advance.
  • We display a banner on the site during the notice period.
  • Modifications affecting already-paid journeys require your explicit consent; modifications that don't affect them apply automatically post-notice.

11.Dispute resolution

Good faith first: if something goes wrong, write to us. We try to resolve through dialogue before formal action.

Mediation: if direct conversation doesn't work, we attempt mediation with a neutral third party before litigation.

Applicable jurisdiction: [Pending — to be defined based on the final legal entity once F4 closes. Until then, agreements are interpreted in light of laws applicable to the payment provider and Peru as the place of service execution.]

Contract language: the Spanish version of these terms is the original. The English version is referential. In case of conflict, the Spanish version prevails.

12.General provisions

Severability: if a clause is invalid or unenforceable, the rest of the terms remain in effect.

Entire agreement: these terms, together with the specific journey proposal and the privacy policy, constitute the agreement between you and Journee.

Waiver: if we don't exercise a right in a given case, that doesn't mean we waive it for future cases.

Assignment: you cannot assign your rights under these terms to third parties without our written consent. Journee may assign its rights to a successor entity (for example, when the final Peruvian SAC is formed).

Disclaimer: this document is a draft prepared by the Journee team. Final validation by a lawyer specialized in international tourism is pending. Once the final legal entity closes (F4), we will update placeholders and re-validate the content.
